Terrorist watch lists: Are they working as they should?

Tamerlan Tsarnaev landed on America's terrorist watch list in 2011. Tamerlan's younger brother, Dzhokhar, now charged in the Boston Marathon bombing case, seems not to have made the list.

Ultimately, Tamerlan's inclusion on the watch list did not lead investigators to detect the April 15 bomb plot that killed three and wounded at least 260 ? prompting inevitable questions about why not, and whether "dots" of intelligence and information that could have been connected were not.

America's terrorist watch list is all about connecting dots ? and it is certain to be a focal point for future congressional hearings pegged to the Boston case. A key part of the vast counter-terrorism net cast by the federal government after the 9/11 attacks, the watch list is actually at least nine lists drawn from a single government database. Criteria for determining who gets "nominated" for inclusion in that database ? and, then, who actually makes it onto an agency's specific list ? are tightly guarded secrets.

RECOMMENDED: Quiz: How much do you know about terrorism?

What does seem clear, however, is that the spigot opened wide in the past three years, leading to torrential growth in the core terrorism database. Whether those extra mounds of data give investigators a more accurate view of the universe of terrorists, or whether they have the unintended effect of making prospective terrorists harder to find and the dots harder to connect, is a matter of hot debate ? and one that the Boston bombing case may well intensify.

"There's absolutely no question that they're just choking on the volume of information, both classified and unclassified, that's going into the system," says Dakota Rudesill, a visiting professor at Georgetown University Law Center who served, during President Obama's first term, as special assistant in the policy, plans, and requirements directorate of the Office of the Director of National Intelligence, which includes the National Counterterrorism Center. "You're taking on this immense challenge with all this data ? like finding a particular needle in a haystack of needles."

US officials bridle at inferences that the system is overwhelmed.

"Certainly, the volume has grown, and the list has grown for a number of reasons," says a US counterterrorism official who spoke on background because he is not permitted to speak on the record. "The intelligence is better; the value of sharing information is seen as better by the agencies involved. The watch list is created specifically to be one of the big dot-connectors in the counterterrorism effort ? it's among the most sophisticated systems the government has ? and it's proven itself to be effective."

THE MAKING OF THE WATCH LISTS

Like a giant digital vacuum, the Terrorist Identities Datamart Environment (TIDE), a highly classified database maintained by the National Counterterrorism Center in McLean, Va., each day sweeps up thousands of names, aliases, birth dates, and other potential terrorist tidbits ? known as "derogatory information" ? and tries to match them with hundreds of thousands of names, faces, and identifying biometric data also sent in by the Central Intelligence Agency, the State Department, the Federal Bureau of Investigation, and other US agencies.

"TIDE is the granddaddy repository ? not a watch list itself, but it feeds the lists," says Mark Randol, a specialist on domestic intelligence and counterterrorism formerly with the Congressional Research Service (CRS). "The whole deal with a watch list is that you need a place where the objective is to see if you can identify, and stop, people you think are terrorists from just coming into the US and disappearing into the woodwork to plot attacks."

As of December, TIDE contained the names of 875,000 individuals (not including aliases), the counterterrorism center reports. Each day, TIDE sends a river of new names to the Terrorism Screening Center, run by the FBI. The screening center combines TIDE's names with those on the FBI's own domestic terrorism list to create the Terrorism Screening Database (TSDB) ? America's master terrorist watch list.

Both TIDE and the TSDB have been expanding fast. TIDE grew from 740,000 names in 2011 to 875,000 in 2012 ? an 18 percent jump. The TSDB, for its part, jumped 23 percent from 423,000 individuals in May 2010 to 520,000 in October 2012, according to the CRS and the Terrorism Screening Center.

What happens to the identifying information about a known or suspected terrorist after it is put onto the master terrorism list? The FBI's screening center sends that information to four US agencies with primary responsibility for straining out would-be terrorists, which then add it to their own unclassified watch lists.

State Department. Its Consular Lookout and Support System (CLASS) screens passport and visa applicants.

Department of Homeland Security (DHS). It uses the Traveler Enforcement Compliance System (TECS), which flows into the Interagency Border Inspection System and the Automated Targeting System ? lists used by the US Customs and Border Protection for border and port security.

FBI. Its National Crime Information Center list is disseminated as a tool for police departments across the United States. The bureau also has its own Guardian database (different from the TSDB), and Tamerlan Tsarnaev was reportedly on it.

Transportation Security Administration. The TSA, part of the DHS, keeps three air-passenger screening lists ? "no fly," "selectee," and "secure flight." The no-fly list is one of the most exclusive watch lists, winnowed to those tagged as possible terrorists who are to be blocked from getting on a US-bound flight. The selectee list signals that an air traveler requires extra screening but being on that list does not necessarily prevent that person from boarding. Both lists have about 20,000 names, the Terrorism Screening Center reports. The secure flight list allows expedited boarding for passengers whose prescreened personal information is compared with watch list data.

Actions that lead to a person being nominated to TIDE as a "known or suspected" terrorist include engaging in terrorist activity, preparing or planning an attack, gathering information on targets, raising funds for attacks, and soliciting membership in a terrorist organization. Less-obvious criteria remain cloaked in secrecy, including nominations that come from foreign intelligence agencies. In 2009, the FBI's own inspector general noted some dissatisfaction with the process, saying the bureau "failed to nominate known or suspected terrorists in 15 percent of the cases we reviewed."

Getting off the list has been problematic, too. The inspector general criticized the FBI for being "untimely in its removal of the subjects" from the watch list in 72 percent of cases reviewed. Travelers who are often delayed at airports are not usually on a watch list; rather, their names and personal information are similar to that of someone who is. In 2012, at least 14,000 records were deleted from TIDE or terrorist watch lists after it was determined that the people no longer met the criteria for inclusion, the counterterrorism center says. US residents make up about 1 percent of TSDB listings.

But civil liberties experts are not satisfied.

"We still don't have access to the information we need to allow us to evaluate how well it's working or how many [who should not be on the list] have been able to get off," says Sharon Bradford Franklin, senior counsel at The Constitution Project, a Washington-based civil liberties group.

HOW TSARNAEV MADE THE WATCH LIST

In March 2011, the FBI interviewed Tsarnaev after Russian intelligence services warned that he had become radicalized. By June, the FBI concluded a basic "assessment" without adding derogatory data to his file, The Washington Post reported. His name, however, did remain in the FBI's Guardian database ? an internal watch list.

In September, the Russians again sent up a flare about Tsarnaev's radicalization, this time to the CIA. By year's end, his name had been added to TIDE and the TSDB watch list, the Post reported.

Three days before Tsarnaev left for southern Russia, his name popped up in the TECS system. It is not clear why the rising number of red flags ? including his travel to a part of Russia where Islamic radicals are active and his online postings of jihadist videos ? did not set off alarm bells. Some analysts say they believe that some important details simply didn't make it into the database.

"If they get the Russian tip, and they were also aware of [the] fact he was visiting Russia and jihadist websites, then I'm not altogether convinced the FBI would have said they found nothing on him," Mr. Randol says. "The fact they didn't see a problem means to me they were not aware of these details."

THE NEAR MISS THAT CHANGED WATCH-LISTING

Connecting dots so that clues are not left floating in a sea of data was a top goal after the near-miss Christmas Day bombing attempt in 2009. Nigerian national Umar Farouk Abdulmutallab famously tried to blow up a Detroit-bound airplane using plastic explosives hidden in his underwear.

On Nov. 18, 2009, Mr. Abdulmutallab's own father reported his son's radicalization to US Embassy officials in Nigeria. A week later, the son's name was added to TIDE, but not to the watch list ? in part because the source of the derogatory information was not included, weakening it. Five weeks later, Abdulmutallab tried to blow up the plane.

Afterward, President Obama ordered a review to determine why Abdulmutallab's name had not appeared on the master watch list. Later in 2010, the nominating criteria changed, with the result that more names and data flowed into TIDE and the TSDB. One measure of the increase: The number of US citizens and lawful permanent residents on the no-fly list more than doubled, the Government Accountability Office (GAO) found in a 2012 study of watch list changes.

Even before the changes, concern was evident within the intelligence community about the huge amount of data being funneled into TIDE. Back in March 2010, Russell Travers, then deputy director of information sharing and knowledge development at the National Counterterrorism Center, told a Senate panel that the inflow of 10,000 names a day to TIDE had required some adjustments. Among them was the advent of special "pursuit teams" of analysts to explore threads, threats, and loose ends that would help "connect the dots," he said, acknowledging that the step was "an experiment."

The 2012 GAO report likewise noted concern among "nominating agencies" about their abilities to process so much information ? especially after the changes that followed the underwear bombing attempt. It noted that "agencies are ... pursuing staffing, technology, and other solutions to address challenges in processing the volumes of information."

A NOTABLE WATCH LIST SUCCESS

Despite the fire hose of incoming information, the US saw some success in apprehending terrorism suspects. After someone tried to set off a car bomb in New York's Times Square on May 1, 2010, investigators traced the crime to Pakistani-American Faisal Shahzad ? and added his name to the no-fly list at 12:30 p.m. on May 3. Later that evening, Mr. Shahzad was indeed attempting to make his getaway to Pakistan. Minutes before his flight was to depart, authorities spotted his name during a final check.

"What used to happen in days now happens in minutes or seconds," the US counterterrorism official says of recent watch list updating and technology upgrades. "The Times Square bomber actually got on the plane thinking he was getting away. But we have a real-time transactional interface with the Customs and Border Patrol. They screened the passenger manifest, arrested him, and took him off the plane."

Today, says the US counterterrorism official, the backlog of information has been eliminated and analytical resources are adequate. The number of names on the TSDB fluctuates, but during the past year appears to have "leveled off" at about a half million, he says.

UNCONNECTED 'DOTS' IN TSARNAEV CASE?

Questions remain, however, about the government's handling of Tsarnaev during the year leading up to the Boston bombings. Some wonder why he was not a candidate for extra scrutiny by a pursuit team or by the FBI. Others ask why federal authorities did not inform local police of the warnings about Tsarnaev's possible radicalization, so they could possibly keep an eye out.

Were there dots that, if connected, would have led to closer FBI scrutiny and prevention of the Boston Marathon bombings? If so, did data overload play a role?

"No, actually more data makes it more effective," insists the counterterrorism official. "The more derogatory information in there, the better able the system is to screen, and the better the whole system works."

But data overload is likely to be raised in future hearings on Capitol Hill, some say.

"I hope the Boston case will lead to a new revision of the watch list, to see whether we are adding just too much information on people so that it leads to a needle-in-the-haystack problem," Randol says.

"Right now, it isn't clear that there are plans in place to review the effectiveness of the watch list or whether the level of misidentification is growing because the haystacks are getting too big."

Report: NPS hantavirus response followed policy

YOSEMITE NATIONAL PARK, Calif. (AP) ? Federal investigators probing the hantavirus outbreak blamed for three deaths at Yosemite National Park recommended on Monday that design changes to tent cabins and other privately run lodging first be reviewed by National Park Service officials.

The report released by the Interior Department's Office of Inspector General found that park officials responded to last summer's outbreak appropriately and within department policy.

"When the outbreak was identified, NPS mobilized to contain and remediate the outbreak and to prevent further outbreaks," Mary Kendall, a deputy inspector general, wrote in a letter attached to the report.

Still, the report found that current policy didn't require park officials to approve design changes made to the "Signature tent cabins" by concessionaire Delaware North Companies Parks and Resorts, which added rafters and wall studs to the structures.

Investigators determined that deer mice, which can carry the illness, nested inside the double walls of the new tents in Yosemite's family friendly Curry Village.

At least eight of the nine tourists who fell ill stayed in the tent cabins.

Because the changes to the cabins were considered routine maintenance, current park service policy did not require prior approval, the report found.

The report also recommended that the park service begin cyclical pest monitoring and inspections of all public accommodations.

While there is a current pest monitoring program at Yosemite, Delaware North was responsible for Curry Village, which was not considered at high risk for hantavirus.

The company issued a statement late Monday saying it would follow the recommendations in the report.

"DNC Parks & Resorts at Yosemite has consistently worked hand-in-hand with the National Park Service and public health officials on this issue," spokeswoman Lisa Cesaro said in the statement. "The Signature Tent Cabins have been removed from Curry Village. We are following the recommendations by the National Park Service, which were developed in consultation with the California Department of Public Health and the Centers for Disease Control and Prevention."

Prior to the outbreak, Delaware only responded to pests in the cabins when visitors or housekeeping staff complained, the report said.

AAA Mich.: Gas prices rise 10 cents over past week

DEARBORN, Mich. (AP) -- AAA Michigan says gasoline prices have risen about 10 cents during the past week to a statewide average of about $3.88 per gallon.

The auto club says Monday the average is about 13 cents per gallon more than last year at this time.

Of the cities it surveys, AAA Michigan says the cheapest price for self-serve unleaded fuel is in the Saginaw and Bay City areas, where it's about $3.83 a gallon. The highest average is in the Marquette area at about $3.95.

Dearborn-based AAA Michigan surveys 2,800 Michigan gas stations daily. The auto club's weekly Fuel Gauge report typically is released on Mondays. Due to next week's Memorial Day holiday, AAA says the next report is expected to be released on May 28.

Oil price falls below $96 a barrel

BANGKOK (AP) ? The price of oil fell Monday ahead of the release later this week of economic data from the U.S. and China, the world's two largest economies, and a speech by the Federal Reserve chief.

Benchmark crude for June delivery was down 55 cents to $95.47 a barrel in electronic trading on the New York Mercantile Exchange. The contract rose 86 cents to close at $96.02 a barrel on Friday.

Later in the week, the U.S. government will release home sales and durable goods orders for April and HSBC will release its monthly survey on China's manufacturing growth.

Analysts are also awaiting testimony Wednesday from Ben Bernanke, who heads the U.S. central bank. Of special interest are any possible hints that the Fed might be preparing to scale back its super-loose monetary policy because recent data has pointed toward a sustained economic recovery.

"Markets will be watching closely for any signs of what the Fed's next move will be," said analysts at DBS Bank Ltd. in Singapore in a commentary.

Brent crude, a benchmark for many international oil varieties, fell 56 cents to $104.08 a barrel on the ICE Futures exchange in London.

In other energy futures trading on Nymex:

? Wholesale gasoline fell 0.9 cents to $2.89 a gallon.

? Heating oil fell 1 cent to $2.924 a gallon.

? Natural gas gained 8.7 cents to $4.14 per 1,000 cubic feet.

Obama's Approval Rating Survives Scandal Week

Here's one place where the president didn't have a dramatic week: in his approval ratings. According to two polls ? the Gallup daily tracking poll, and a CNN/ORC International poll released Sunday ? Obama's approval rating has more or less remained steady as potential scandal upon potential scandal blew up the news cycle.?

RELATED: Obama's Second Term Isn't Dead Yet

First, here's CNN's poll, conducted over May 17-18. According to their survey, Obama's approval rating is at 53 percent. While that's a two percent rise since early April, the difference is within the margin of error of the survey, so we'll say that the president's approval rating here remained steady. Forty-five percent of Americans, meanwhile, disapprove of the job the president's doing.?

RELATED: What Are the Solutions to This Week's Scandals?

Gallup's results are similar. Right now, the president is registering a 50 percent approval rating, with a slight increase over the course of Scandal Week that's within the survey's margin of error. Here's Gallup's tracking polls, graphed, since the end of April 2013:?

RELATED: Obama's Scandal Pivot: Dare Congress to Actually Pass Laws

RELATED: Republicans Want to Slow Down the Scandals

But that doesn't mean Americans aren't paying attention to the administration's troubles this week. While a separate Gallup poll this week found that American attention to the Benghazi and IRS stories this week was actually below average for other news stories they've tracked, most Americans (54 percent for IRS and 53 percent for Benghazi) were following the stories either "very" or "somewhat" closely, and most (74 percent and 69 percent, respectively) believe both stories warrant further investigation. In the CNN poll, majorities of respondents believing the IRS and Benghazi stories (55 percent) are important to the nation, while 53 percent would say the same about the AP phone records story.

RELATED: Which House Committee is Investigating Which D.C. 'Scandal': A Scorecard

One further note: according to CNN's results, it looks like Americans are are at least a little less likely to buy that the Benghazi and IRS stories represent the exposure of a conspiracy on the part of the White House: While a majority (53 percent) of Americans are dissatisfied with the president's handling of the Benghazi attacks and the ensuing political aftermath, 50 percent believe that the administration's inaccurate statements after the attack represented what they believed had happened at the time. Forty-four percent believe the administration intentionally misled the American public. Similarly, 55 percent of Americans believed the IRS acted on its own to target "Tea Party" and "Patriot" groups for extra scrutiny, while 37 percent thought the agency was acting under the White House's orders.?

Murray Lipp: Public Protests and Pride Parades: The Power of Participation

2013-05-18-doma200.jpgAs we move through life we each leave a legacy, a personal imprint on the world. For me, an increasingly important and meaningful part of my personal story is my engagement in LGBT activism and my participation in LGBT cultural events.

I have attended four LGBT-related public protests in recent months and I am eagerly awaiting the 2013 LGBT pride parade season in New York City. Both types of events -- protests and parades -- are very empowering ways in which to participate in society and help effect societal change.

One of the defining characteristics of the LGBT community is our resilience and refusal to accept oppression. We're also known for our capacity, as a community, to put on a grand party when the situation demands it. Public protests and pride parades, respectively, play a key role in challenging discrimination against LGBT people and celebrating LGBT diversity.

Public Protests (Same-Sex Marriage in New York)

2013-05-18-protest200b.jpgA public protest is a form of direct action whereby a group or community of people comes together, in a public manner, to express opposition or discontent about some type of unsatisfactory or unjust situation. While the aim is to communicate a message to the broader public about a given topic or issue, there is also the hope that this engagement with society will lead to positive social change.

From the historic Stonewall 'uprising' in New York City in 1969, to the HIV/AIDS protests in the 1980s/90s, through to the marriage equality rallies across the USA in 2013, the LGBT community in America has a long and rich history of publicly advocating for societal change. Through protests and collective action, the private and individual experience of discrimination is given a very necessary public stage. When the same 'private troubles' are experienced by a mass of individuals, such problems become 'public issues' requiring group level intervention (see C.Wright Mills and The Sociological Imagination). Discrimination against LGBT people is a prime example.

My foray into LGBT-activism was in 2009 in New York when efforts were being made to legalize same-sex marriage. While I had started an online campaign to promote the legalization of gay marriage in New York, I decided I also needed to participate in direct action events or 'real-world' (organic) activism as I call it. I wanted to connect with others in a more human way -- not just online -- and I wanted to be able to document these experiences for those who couldn't or wouldn't participate.

So I began attending LGBT-related political rallies in New York and started taking photos of what I saw at these events. From Equality & Justice Day 2009 in Albany lobbying state politicians, to marriage equality rallies in Queens and Manhattan, I started to get a sense of how significant and important these events were in exerting influence over broader society. While same-sex marriage was not legalized in 2009, these collective and direct action efforts certainly paved the way for future change.

By the time 2011 arrived, New York had been primed for the legalization of same-sex marriage. Various protests and rallies were held by pro-marriage equality advocates in the months leading up to the successful vote in the New York legislature in June 2011. Looking back on that period it is with a sense of satisfaction that I can say I participated in a number of these. I attended Equality & Justice Day 2011 in Albany, I photographed a rally against an anti-gay politician in Brooklyn, and I participated in two marriage equality rallies in Manhattan (Stonewall Inn rally, Union Square rally).

Public Protests (National Marriage Equality and Other LGBT Issues)

2013-05-18-nem.jpgMy experiences with real-world activism in New York in 2009 were accompanied by a growing desire to participate in societal change at a more national level. Attending the National Equality March 2009 was an inspirational experience in this regard. Marching together with thousands of LGBT people and our allies from all across the country in a united voice against LGBT-related discrimination was empowering and exhilarating.

After participating in New York City's inspiring 'End DOMA' rally in March 2013, I became aware of an intense desire to participate in the Supreme Court rallies that had been planned for later that month to coincide with the Prop 8 and DOMA hearings. I attended the March 27 DOMA rally in Washington DC and it was indeed an amazing experience. I will never forget the joy and exhilaration of being amongst the cheering crowd that greeted Edie Windsor (DOMA complainant) when she emerged from the Supreme Court after the hearing (see my video tribute to Edie Windsor here).

More recently, in recognition of the fact that marriage inequality is not the only issue that negatively impacts LGBT people, I've attended two protests relating to other forms of LGBT discrimination. In early May 2013 a group of LGBT Catholics and allies engaged in a vigil outside St. Patrick's Cathedral in New York City in protest of Cardinal Timothy Dolan's suggestion that LGBT people should wash their hands before entering a Catholic Church. As an observer I was on hand to photograph and document this action. This past week, in response to anti-gay violence in New York City, I attended the 'Take Back the Night' rally in Manhattan joining together with other New Yorkers in condemning homophobic abuse.

Participating in public protests and direct action efforts are not for everyone, however. LGBT people who are not 'out' to friends and family are highly unlikely to attend such events due to the potential public exposure. Others cannot break away from commitments and responsibilities such as work and family. There are also those of course who simply have no interest in participating in these types of societal actions. As someone who has the capacity and the desire to participate, I now increasingly feel a personal obligation to do so -- not only to show my personal support for these causes but to photographically document these events for those who cannot or will not attend.

Pride Parades (New York City)

2013-05-18-pride200.jpgIt's not just protesting and rallying, however, that the LGBT community has developed particular skill in. With roots in the 1969 Stonewall movement, LGBT pride parades are now held annually in various cities across America, all aiming to celebrate and honor the diversity and validity of LGBT identities and culture. While protests have as their starting point a need and desire to challenge something unacceptable (e.g. discrimination), parades have as their starting point a wish to celebrate something positive (e.g. human diversity).

Some people question the necessity of LGBT pride parades and reference the fact that there aren't 'straight pride parades.' Indeed, there would be no purpose for the latter because straight people are not an historically oppressed minority group. Straight people, as a group, are not subjected to violence and oppression the world over simply for being 'straight.' We live in a society which to a large extent remains structured around the erroneous assumption that all people are straight. Slowly, that is changing. It's fair to say, however, that in many places around the world each day still seems like one massive 'straight pride parade' in which the lives and culture of LGBT people are seldom featured or reflected.

In this sense LGBT pride parades aim to empower LGBT people by, firstly, acknowledging our very existence and, secondly, by celebrating our diversity and culture. Such parades are not an effort to promote separatism or to communicate any degree of superiority or inferiority. They aim simply to validate and celebrate a group of people who have historically been demonized by broader society.

My own personal experience of participation in LGBT pride parades began in 2011. Despite having lived in New York City for nearly four years by that point, I had not once attended a pride parade. With my growing interest in political activism and photography, however, I hit the pride parade scene in June 2011 and what a blast I had. It started with Queens, then Brooklyn, and then the biggest one of them all, the Manhattan pride parade. A month later, in July 2011, I was present outside the NYC Office of the City Clerk to photograph the first group of same-sex couples issued marriage licenses in NYC, a day which itself became an impromptu 'pride parade' and cultural celebration.

In 2012, hooked from the previous year's participation in pride parades, I repeated the Queens, Brooklyn and Manhattan trifecta taking hundreds of photos in the process and sharing them online across the Gay Marriage USA Facebook network.

While right-wing anti-gay conservatives hysterically argue that LGBT pride parades are simply an effort to promote some kind of 'deviant sexual lifestyle,' the truth is something very different. While pride parades feature a collection of characters in outlandish costumes who dress-up intentionally for the occasion, they also feature the participation of regular LGBT folks wearing regular clothes honoring their regular lives. Like any community or group of people, we (LGBT people) are a mixed one that incorporates the mild to the extreme and everything in between.

Participation, Photography, and History

2013-05-18-pride200b.jpgAs direct action efforts advocating for the legalization of same-sex marriage continue across the country, and as the LGBT pride parade season looms on the horizon, I encourage those LGBT people who have never participated in a public rally or a pride parade to seriously consider doing so. There is something particularly powerful and meaningful about participating in these public events that literally do have the potential to change society and to change lives.

I agree that online activism is fueling a rapid change in attitudes about LGBT rights and helping to fast-track the path toward full equality, and I will continue to engage in it via Gay Marriage USA. On the other hand, our daily lives are becoming so heavily impacted by social media and online activities that sometimes it's easy to forget about the 'real world' out there, that one that has streets and people and noises and aromas.

We must continue to recognize the importance of real-world public protests and pride parades in helping to shape society in ways which ultimately benefit us all. In that regard, I will continue to find meaning and satisfaction in attending and photographing these events and playing my small part in helping to effect historic social changes. Helping to create a world which is kinder to LGBT people has become an important part of my life story and my contribution to society.

The Newest 3D-Printed Gun Is Far More Dangerous For Much Cheaper

After the stir several weeks ago, buzz surrounding Defense Distributed's 3D-printed gun has begun to (somewhat) die down. This is probably due in part to Kim Dotcom's removal of the gun's blueprint from Mega and the fact that, frankly, the gun itself isn't much of an immediate threat. But as one potential threat dissipates, just like clockwork, a new one has appeared on the horizon. And any fear creeping up on you with this newest incarnation of the 3D-printed gun might actually be warranted.

Wyo. student who threatened to rape self on Facebook was convicted of assault

The 28-year-old University of Wyoming student who allegedly threatened herself with rape in a Facebook hoax in April was convicted of aggravated assault in 2005 after she brandished a gun at an employer who fired her.

Meg Lanker-Simons, now a newly-minted UW graduate, was charged with interference with a police investigation after she allegedly posted on an anonymous Facebook forum that she wanted to engage in angry sexual intercourse ? with someone named ?Meg Lanker Simons.?

The posting on UW Crushes read:

?I want to hatefuck Meg Lanker Simons so hard. That chick runs her liberal mouth all the time and doesn?t care who knows it. I think its so hot and makes me angry. One night with me and shes gonna be a good Republican bitch.?

It turns out that the April 24 incident isn?t the strident leftist?s first rodeo in Wyoming?s criminal system. As the Laramie Boomerang reports, Lanker-Simons had an aggravated assault conviction in 2005 as the result of a bizarre gun-brandishing incident.

After Lanker-Simons was fired from a radio station in the fall of 2005, she returned and pulled a Glock 22 .40 caliber handgun from her purse. She waved the semi-automatic pistol around. She pointed it at the man who sacked her. He testified that he was ?in fear for his life,? notes the Boomerang.

The radio station was evacuated. Police caught Lanker-Simons as she tried to flee the scene in her vehicle. They held her at gunpoint.

In July 2006, Lanker-Simons ? then known as Meghan Michelena ? was sentenced to six years of probation. Her term of probation was subject to a number of conditions. She had to undergo counseling, complete community service, pay fines and apologize to her victims. She was also prevented from owning any guns.

The alleged Facebook hoax brought national attention to the Cowboy State?s flagship college. Initially, the administration stood firmly behind Lanker-Simons. ?No student should have to deal with such threatening language,? said one sternly-worded official statement. A school official also denounced ?rape culture,? according to KOWB.

Concerned fellow feminists also threw a rally for Lanker-Simons ? complete with all manner of signs condemning rape threats ? before police concluded that Lanker-Simons herself was behind the threats.

This month, Lanker-Simons participated in the University of Wyoming?s commencement ceremonies despite the charges against her. She graduated with a bachelor?s degree in psychology.

Lanker-Simons is also a blogger and a local radio host.

In 2010, Lanker-Simons and Bill Ayers sued the University of Wyoming after school officials decided to cancel a speech by Ayers, a former Weather Underground radical and mentor to President Obama. Also in 2010, her husband, Andrew Simons, ran a failed Democratic campaign for Wyoming secretary of state.

According to the Boomerang, the interference charge is a misdemeanor punishable by a prison sentence up to a year and a fine up to $1,000.

Will Facebook Buy Tumblr Instead Of Yahoo? - Business Insider

Yahoo's board is meeting Sunday evening to decide whether to buy Tumblr for $1.1 billion in cash, Kara Swisher and Peter Kafka reported last night.

So that means there are only a few hours left for Facebook to submit a compelling counter-offer.

Anecdotally, young people are deciding that Facebook is no longer cool and are decamping for Instagram and Tumblr.

Facebook already owns Instagram.

So now the question is whether it also wants to own Tumblr.

The man who broke the original Yahoo-might-buy-Tumblr story (along with Ms. Swisher), Peter Kafka, told us this morning that thinks the chatter that Facebook will swoop in with a massive wad of cash at the last moment is overblown.

Facebook has had plenty of opportunity to buy Tumblr, Mr. Kafka suggests.

If Facebook actually wanted Tumblr, in other words, Facebook would have already bought Tumblr.

So that leaves Yahoo.

According to Ms. Swisher and Mr. Kafka, the Yahoo-Tumblr deal is already fully baked, with Tumblr founder David Karp getting a four-year deal to stay on as Tumblr boss and grow the site independently from Yahoo. This may mean that Yahoo is not planning to aggressively "monetize" Tumblr after the deal, and that Yahoo will therefore not have to deal immediately with Tumblr's reported porn problem.

The $1.1 billion purchase price, meanwhile, will vaporize more than a third of Yahoo's cash balance, which will presumably leave some at the company wondering whether Yahoo should have spent so much money buying back its stock over the last couple of quarters.

In any event, we'll know in a few more hours whether Facebook really wants Tumblr or whether it's going, going, gone to Marissa Mayer and Yahoo...

Apple Patent Would Turn Your Friend's iPhones Into a Lighting Kit

If you've ever been on the set of a professional photography shoot, you'll notice the photographer doesn't just rely on a single camera-mounted flash. Instead, they use a series of strategically positioned flashes, all tethered together so they function as one, to precisely control where and how much light is hitting the subject. And that approach is very similar to a patent Apple originally filed back in 2011 that could dramatically improve your iPhone's photography prowess.

But instead of wirelessly connecting the phone to a series of dedicated external flashes, the patent actually sees the iPhone connecting and controlling the flashes on other nearby iPhones. So not only would it increase the amount of light available to an iPhone photographer depending on how many other phones are around, but it could also let them get more creative with their shots.

A method for capturing an image with an image capture device, such as a camera or mobile electronic device. The method includes initiating a master-slave relationship between the image capture device and at least one secondary device. Once the master-slave relationship is initiated, remotely activating one of an at least one light source of the at least one secondary device.

The patent goes one step further describing tools that automatically analyze the lighting in a sample shot, and then tweaking the intensity or timing of the flashes on the other iPhones to improve the photos. It even suggests a method of passing along instructions to people holding the other iPhones as to where they should move or stand to improve the overall lighting.

Of course, the patent doesn't necessarily mean we'll be seeing this technology included on the next iPhone?or any iPhones down the line for that matter. As with most patents it's most likely a move by Apple to control another technology or feature?whether they intend to implement it themselves one day, or go to court when another company tries to. Researchers discover master regulator that drives majority of lymphoma

Tuesday, May 14, 2013

A soon-to-be-tested class of drug inhibitors were predicted to help a limited number of patients with B-cell lymphomas with mutations affecting the EZH2 protein. However, a research team, led by investigators at Weill Cornell Medical College, now report that these agents may, in fact, help a much broader cross section of lymphoma patients.

The study, reported in Cancer Cell, found that the EZH2 protein the drug agents inhibited is a powerful regulatory molecule in B-cells, and a key driver of cancer in these immune cells.

The study's lead investigator, Weill Cornell Medical College's Dr. Ari Melnick, suggests that combining an EZH2 inhibitor with another related targeted therapy may offer a much improved treatment for follicular lymphoma, a cancer that currently has no cure, as well as a non-toxic alternative to chemotherapy for at least a third of diffuse large B-cell lymphomas. Because these two lymphomas account for 70 percent of adult lymphomas, Dr. Melnick believes the new therapy could potentially help a broad cross section of lymphoma patients.

"Our research indicates that these inhibitors will be remarkably effective. I am very optimistic," says Dr. Melnick, the Gebroe Professor of Hematology/Oncology, professor of medicine and director of the Raymond and Beverly Sackler Center for Biomedical and Physical Sciences at Weill Cornell. "Researchers had thought EZH2 inhibitors would only help patients with a mutation in their EZH2 gene, which represents a small subset of lymphoma patients. What we found is that a majority of lymphomas turn out to be dependent on normal EZH2, not just mutated EZH2."

Tumor Cells Depend on the EZH2 Master Regulator

The new study was aimed at understanding what normal as well as mutated EZH2 does within B-cells -- basic information that remained unknown despite more than a decade of research into the protein.

The role of B-cells (white blood cells known as B-lymphocytes) is to produce antibodies against invading microbes. What the researchers discovered is that EZH2 is required in order for the immune system to generate germinal center B-cells, which are the cells that make the most powerful type of antibodies.

Germinal center B-cells divide extremely quickly and try to create within them the high affinity antibodies that will be beneficial to fight off invading infections. This process happens constantly because of our exposure to microorganisms.

"Most B-cell lymphomas arise from germinal center B-cells -- germinal centers are the engine for formation of lymphomas," says Dr. Melnick. "The reason for this is because germinal center B-cells divide very, very quickly while at the same time mutating their antibody genes. Unfortunately, many other genes get mutated when this happens, which can eventually result in lymphoma formation."

It turns out that the behavior of germinal center B-cell is orchestrated by EZH2, Dr. Melnick discovered. "EZH2 is a master regulator protein that turns off the brakes that prevent cell division, so it allows cells to divide without stopping," he says.

EZH2 also has a second function, which Dr. Melnick calls "surprising and perhaps even more important.

"It prevents germinal cells from transitioning to antibody-secreting cells," he says. "Indeed, in the normal immune system EZH2 prevents B-cells from exiting germinal centers so that these cells can continue to undergo sustained rapid cell division, which continues until the immune system says to stop. Then EZH2 goes away, and B-cells can develop into antibody-secreting cells, which send antibodies into the circulation to fight off infection."

Interestingly, mutations of EZH2 cause it to be even more efficient at promoting germinal center B-cell division and permanently keep them locked in this behavior, Dr. Melnick says. But he adds that most lymphomas that are derived from germinal cell B-cells are dependent on EZH2, whether normal or mutated, to sustain growth.

"Germinal center cells absolutely require EZH2 and the lymphomas that arise from germinal center cells inherit that need regardless of whether they have mutations," Dr. Melnick says. "We discovered that it is not just the small percentage of patients with EZH2 mutations who are candidates for these inhibitors. It is actually most of the lymphomas that originate from germinal center B-cells -- and that represents the majority of patients."

The researchers report the development of a novel and highly specific EZH2 inhibitor, tested its effects against large panels of lymphoma cells and found that it works particularly well against germinal center-derived lymphomas regardless of whether or not they have EZH2 mutations.

"The case of EZH2 exemplifies a critically important emerging concept in cancer -- that tumor cells are dependent on the master regulators that are required to sustain the normal cell type from which they originate," Dr. Melnick adds.

According to researchers, another implication of the study is that it may be possible to combine an EZH2 inhibitor with a drug that targets BCL2, which is also in clinical testing, to achieve a more powerful synergistic effect.

"EZH2 and BCL2 mutations tend to occur together in germinal center derived lymphomas. In our report, we show that indeed these two genes cooperate to drive lymphoma formation from germinal center B-cells, and so a combination therapy that inhibits both genes might offer a very powerful therapy," says Dr. Melnick. "Indeed, combining EZH2 inhibitors and BCL2 inhibitors had a much greater effect in cells and in animal models of lymphomas than either drug alone." These results pave the way for translation of combinatorial-targeted therapy for patients with incurable lymphomas.

What's the Most Important Building In America?

In a special called Ten Buildings that Changed America that aired on PBS this week, critics and historians schooled us on ten of the most significant structures in the country. Did they miss anything?

Writer and producer Dan Protess' picks ranged from inspired (Louis Sullivan's Wainright Building, the first skyscraper in the world), to surprising (Victor Gruen's Southdale Center, one of the original indoor malls), to downright silly (Frank Gehry's Disney Concert Hall, of ill-repute). Of course, trying to quantifying what makes a particular piece of architecture "more important" than the rest is entirely subjective. But that's what makes it so interesting to try.

Which is why we want you, dear reader, to tell us where PBS went wrong. Fire away in the comments below.

(AP) ? Manchester United has hired David Moyes to succeed Alex Ferguson as manager of the Premier League champions.

The club said Thursday he has agreed to a six-year deal and will take charge beginning July 1, marking the end of Ferguson's reign of nearly 27 years at Old Trafford. Ferguson announced his retirement plans Wednesday.

Everton confirmed earlier in the day that Moyes would be leaving and that he met with chairman Bill Kenwright to express his desire to join United.

Moyes has never won a major trophy in his coaching career but should help ensure a smooth transition between Scotsmen at United.

The 50-year-old Moyes has shown loyalty and staying power in his 11 years with Everton ? attributes that should suit him well in his next job. United is trying to avoid any radical changes to its structure after Ferguson joins the boardroom when the season ends.

World's most extreme hearing animal: The greater wax moth

May 8, 2013 ? Researchers at the University of Strathclyde have discovered that the greater wax moth is capable of sensing sound frequencies of up to 300 kHz ? the highest recorded frequency sensitivity of any animal in the natural world.

Humans are only capable of hearing sounds of 20kHz maximum, dropping to around 12-15 kHz as we age, and even dolphins, known exponents of ultrasound, can?t compete as their limitations are around 160 kHz.

The research, conducted at the University?s Centre for Ultrasonic Engineering, has identified the extraordinary sensory characteristics of the moth, paving the way for developments in air-couple ultrasound.

Dr James Windmill, who has led the research at Strathclyde, said: ?We are extremely surprised to find that the moth is capable of hearing sound frequencies at this level and we hope to use the findings to better understand air-coupled ultrasound.?

?The use of ultrasound in air is extremely difficult as such high frequency signals are quickly weakened in air. Other animals such as bats are known to use ultrasound to communicate and now it is clear that moths are capable of even more advanced use of sound.

?It?s not entirely clear how the moths have developed to be able to hear at such a high frequency, but it is possible that they have had to improve the communication between each other to avoid capture from their natural predator ? the bat ? which use similar sounds.?

The research findings will allow the Dr Windmill and his colleagues to further develop their understanding of ultrasound and how to transmit and receive ultrasonic pulses travelling in air.

With frequency sensitivity that is unparalleled in the animal kingdom, this moth is ready for any echolocation call adaptations made by the bat in the on-going bat?moth evolutionary war.

Dr Windmill?s multi-disciplinary research team is now working to apply the biological study of this, and other insect ears to the design of micro-scale acoustic systems. It is hoped that by studying the unprecedented capabilities of the moth?s ear, the team can produce new technological innovations, such as miniature microphones.
